GENERAL RELEASE OF LIABILITY

1. I am voluntarily following the exercise guide provided by kimberlysmithmovement.com. I will be receiving and/or downloading instructions and information concerning fitness and wellness techniques, which may include weight training and other physical activities. I do hereby acknowledge that I have been informed of the need for a physician’s approval for participation in any exercise or fitness activity. I acknowledge that I have either had a physical examination and been given a physician’s permission to participate, or that I have decided to participate in these activities without the approval of a physician and do hereby assume all responsibility for participation.

2. I am willingly and voluntarily assuming any risks, injuries or damages, known and unknown, which I might incur as a result of following the exercise guide and agree that kimberlysmithmovement.com, Kimberly Smith Movement, LLC, or any of its assigns, members, instructors, employees and agents, will not have any liability for such injuries or damages, to the maximum extent allowed by applicable law.

3. I acknowledge and agree that Kimberly Smith is not a medical professional and does not provide any medical diagnoses or treatments. I agree that if I have any medical condition, I will seek the help of a medical professional.

4. To the maximum extent permitted by applicable law, I hereby waive and release any claims, known or unknown, I may have against by kimberlysmithmovement.com, Kimberly Smith Movement, LLC, or any of its assigns, members, instructors, officers, directors, employees and agents, arising from or in connection with the services provided by kimberlysmithmovement.com (“Claims”) and agree to release kimberlysmithmovement.com, Kimberly Smith Movement, LLC, or any of its assigns, members, instructors, employees and agents, from and against any and all Claims.

5. I expressly waive all rights afforded by any statute which limits the effect of a release with respect to unknown claims.
